IIRC you can't trademark an animal, but you can trademark (or perhaps copyright?) a particualr representation of an animal. Imagine trying to use a bipedal black mouse with round ears, white shoes/gloves and red shorts and you'll understand what I mean.

I think you can claim copyright on those anyway, at least in some countries, even without registration. The logo is an original artwork and TortoiseSVN is a neologism and not a common word or phrase.
