Turtles and tortoises are definitely not the same thing. They are both
in the order Chelonia, with tortoises comprising the family
Testudinidae, while turtles are either of the family Cheloniidae (sea
turtles) and Emydidae (fresh water turtles). I don't see making much
progress on people confusing the two names.

As for the artwork, a young Walt Disney created one of the world's most
strongly defended copyrights, Mickey Mouse. Does that prevent other
cartoonists from using rodents? Not if it is Art Spiegelman's Maus, and
not even if it is something as derivative as Robert Armstrong's Mickey
Rat.

But don't let these points deter folks from pretending they know and
practice copyright law.
