I think it is good for ESC to not close the commit dialog any more,
because recently Tmerge is closable with a single ESC (which is really
*GOOD*, thanks!).

My typical workflow in the commit dialog goes like:
:start
double-click file in bottom pane to get diff
without moving mouse, use scroll-wheel to view changes
hit ESC
move mouse few pixels lower to get to next file (possibly while last two
steps in progress)
goto :start

Sometimes this happens very quickly. It is good to not have the fear
that the slightest mistake with ESC could close your commit dialog.

Or did I mis-read this and the ESC is only blocked when the edit box has
focus? In which case this becomes a feature request. :)
