First solution:
Get rid of the "nothing to do" dialog completely.
Add a status message in a spare bit of grey which says either:
a) Getting file status or
b) N changed items or
c) N changed items, M unversioned items

Second solution:
Keep the "nothing to do" dialog, but when it closes, don't close the
commit dialog, so there is a chance to refresh or check unversioned.
You may need 2 versions of the message
a) Existing message if unversioned files _have_ been checked
b) Add extra text to tell the user to check for unversioned file if that
box is not checked.
