Hi Gert-Jan,
I have the same problem.
I'm running TSVN 1.8.1 with server version 1.2. The problem persists on both WinXP and 32-bit Win7.
I'm pretty sure I've been able to add files by doing a clean check-out to another directory then copying the modified files over the top.

After upgrading to 1.8.1 I cannot add files during commit. When using version 1.7 I can, but after upgrading the tortoise client (and upgrading the checkout to version 1.8), whenever I add a file and want to do a commit, I get the error that the file cannot be commited because it is outdated (whilst the added file is really new). Updating doesn't resolve the issue nor does a clean checkout.
