You will have to provide some more detail before the readers of this
list can give advise.

What are the differences between the working and non-working situation?
- Repository URLs
- Connection methods
- Working Copy state (sparse checkout, full checkout etc.)
- Other differences

Are you applying the patch at exactly the same place in both situations?

Is the patch file identical?
