I think that depends entirely on the way the modified version
is presented.

To exagerate slightly, would anyone downloading something from
a website with a click-through banner as shown below believe
they are downloading the original Subversion-1.5?

  YOU ARE ABOUT TO DOWNLOAD SUBVERSION-<VENDOR>-EDITION,
  WHICH IS BASED ON SUBVERSION-1.5 BUT IS _NOT_ THE ORIGINAL
  SUBVERSION-1.5!

  THESE BINARIES HAVE NOT BEEN COMPILED FROM THE OFFICIAL
  SUBVERSION 1.5 RELEASE SOURCE CODE!
  PLEASE ASK US, <VENDOR>, FOR HELP IF THERE ARE ANY PROBLEMS.

Wow, these caps scream at me in terror from the screen now.
I don't think anyone would be confused, unless they can't
read the text for some reason.

Now, I don't really expect to see that exact banner on anyone's website.
Given that "merge tracking preview" releases have been distributed
in the past without causing confusion, it seems the folks at CollabNet
already know how to handle this properly.
