I know that it has, I am just pointing out that the usage is
incorrect when referring to the operating system and *may* be
a trademark infringement.

Back when I wrote the CUPS book, Pearson had the same policy as
O'Reilly - they used Unix instead of UNIX. When I asked about this,
they said they thought that no one owned the trademark anymore.
I pointed them at the X/Open Group page and we had to add a note
in the frontmatter for the word Unix and the trademark UNIX. AFAIK,
Pearson now uses UNIX instead of Unix.

Personally, I think UNIX *has* been diluted in common usage and
the X/Open Group would not have a chance of winning in court for
an infringement case, however I am not a lawyer, and the lawyer
that I did talk to about it recommended using UNIX to avoid any
possibility of an infringement suit. Clearly Pearson thought it
was advisable as well, so I'm opting for the 'safe' route in any
stuff I publish.
