tortoiseSVN: HEAD check when renaming folder

ok, we are still using version 1.7, so I know I cannot submit a new issue, but I have searched the web, release notes and this forum and found nothing like my issue, so I suspect it still is there in the latest version.

My problem is this:
- I had to renamed a folder containing some levels of folders and files
- I performed the TSVN rename and commit
- reports came in of an empty folder somewhere below the folder I renamed

It turned out I had an old workspace where I did the rename. In my workspace the reported folder was still empty. When doing a rename, a copy of the workspace is made to the new folder, so when I did the commit, the status of my workspace was committed, reverting changes made after I made my workspace one month ago.

Me and my collegues feel that this is nasty bug in TSVN. The tool should make sure the user's workspace is at HEAD revision before renaming a directory.
