Ok so then shouldn't this be inbuilt as an option? - not as an after thought ...

This is a design flaw imho. SVN is a VCS and it is failing to perform
its job. File systems *can* be case sensitive. Where it doesn't hold
then SVN should try to work around this behaviour and make its
operations obvious and transparent to users.
So let me get this straight, SVN will not accept patches that provide
a good clean workaround to make the use cases I have outlined to work?

SVN should not go "hide and seek" only repositories that *will* work
but then *not* on some platforms it should *work* everywhere.

I am suggesting that SVN adds a new interface to allow for future
users / programs [which make use] of svn to bypass the silliness of
file systems. This will not break existing users / programs :)
