commit raises "Subverison Exception!"

Hi,

If i commit only some files from a working copy that is checked out into the
root directory of a drive i get the following error message:

Subversion reported then following:
In file ?
'D:
\nightlybuilds\SVN\TortoiseSVN\ext\subversion\subversion\libsvn_client\commit.c'
?
line 1512: assertion failed ((target[0] != '\0') &&
!svn_dirent_is_root(target, strlen(target))) ?

Steps to reproduce the problem:
- create a working copy in the root directory of a drive (or execute subst R:
"path to working copy")
- modify 3 files from 2 different subdirectories
i have tried this with

contrib/TortoiseSig.html
contrib/TortoiseSig.txt
doc/readme.txt

- uncheck contrib/TortoiseSig.txt
- commit

Now the error message above is shown.

This does not happen if
- all files are commited or
- the files are commited from a non root directory

I am using
TortoiseSVN 1.5.99, Build 15589 - 32 Bit -dev, 2009/03/06 21:32:23
