Yes, you can download TSVN from their website. They don't need our
agreement to do so since TSVN is GPL.

And changing the upgrade check is easy:

If they really change that without user confirmation, they've gone too
far. I will do some tests tonight. But if they change the registry
without asking, they will get a nasty email from me. If they won't stop
doing this, they can expect a big warning on the TSVN homepage about
their product...
