I don't think there's much we can do about this.
The first time this question is asked comes when the old version is
uninstalled. The second time when the new version is installed (updating
means first uninstalling the existing version, then installing the new
version).

Since you ignored the files in use when you the existing version is
uninstalled, all those files are not removed but are scheduled for
deletion on the next reboot. Then, when the new version is installed
those files are still there and can't be overwritten because they're
still in use, so you'll get the dialog again.
