Yup, Robert replied off-list explaining exactly that
(probably off-list to save me some embarrassment:)

I read the problem as "with files" and not "within files".

read twice, post once!

Anyhow, I still want to implement the check-case-insensitive
target into a Subnant pre-commit hook, as it is an issue.
