Why are you expecting it to succeed?

Consider:

% svn co ^/ wc
% cd wc
% svn mkdir -mm ^/branches/foo
% svn cp trunk branches/bar
% svn ci -mm

which should fail with 'out of date'.

Therefore I think your case should fail as well.
