I'm not really sure it's client only (we certainly upgraded both at my
site); the mergeinfo you have on particular files isn't really
relevant, the thing that produces empty mergeinfo involves chewing on
it internally and leaving empty leftovers instead of eliding them.
Certainly if you're getting the error, I'd give odds that you're still
running the broken code (the fix looked convincingly complete) so that
strongly suggests you need a server upgrade too.

(If there were workarounds, I wouldn't have had to put so much effort
into it :-) I didn't find any...)
