Checked items stay checked when refreshing. Files that a are new in the
state "modified" are automatically checked since TortoiseSVN 1.4.0

Try the option "Settings/Dialogs 2/Reopen commit dialog after a commit
failed". This will restore your log message and the checked items. This is
available since TortoiseSVN 1.4.0.
