Problem with utf-8 files and applying patches

I've been having problems with using TortoiseSVN to apply patches on
utf-8 files.
Visual Studio by default uses utf-8 encoding for C# files. If I make a
change to a C# file and use Tortoise to create a patch, then revert my
change and then apply the same patch, TortoiseMerge complains that the
patch is outdated. I have played around a lot with this and only get
problems if the byte-order marker for the utf-8 file is part of the
patch. If the patch only changes code further down the file, away from
the byte-order marker then everything is fine.

Is this a bug in Tortoise, or am I doing something wrong?

I'm running TortoiseSVN 1.4.8 on Vista. Any thoughts on this would be
appreciated.
