You could add a 2nd custom format to the clipboard at the same time (ie as well as the text) that just acts as a flag to indicate that the text is a patch.

It would be difficult to tell if the data in the clipboard really is a
patch or just some other text. And that would mean that TortoiseMerge
(which does the applying of patches) would allow to "apply patch from
clipboard" a lot, even if it would fail afterwards.
