There are no duplicates, at least not in the files that I just commited.
When I open these files in a hex editor, the BOMs look OK to me (ef bb bf,
three bytes, no duplicates). Other files don't have any BOMs and the patch
worked there. Is it possible that your editor cannot handle BOMs properly?

That would explain why I couldn't apply your patch to these two files (only
after manually patching the patch)
I'm not sure whether we really need BOMs for english. In german you can run
into trouble with the accented characters if someones editor doesn't handle
utf-8 files without BOMs properly. For consistency I'd suggest to have BOMs
in every file.
