svn + "satisfy-any" broken? directory does not get recursivly checked out

we block one directory to everybody via:

[ts:/]
* = rw

[ts:/testpath]
rupert.thurner = rw
* =

"testpath" can be browsed with tortoise repository browser, or eclipse/
subclipse-svnkit. but when doing a check out of the whole repository,
it does not get checked out. checking it out via specifying the path
works.

this *only* happens in case a
    Satisfy Any
is set in the apache configuration to allow anonymous access as well,
as mentioned http://svnbook.red-bean.com/en/1.5/svn.serverconfig.httpd.html.

could this be a bug, or we overlooked something?
